AI and Data Protection: A UK Guide

AI systems that process personal data must comply with UK GDPR. This isn't optional, and getting it wrong carries significant penalties and reputational risk.
This guide provides practical guidance for UK organisations deploying AI while maintaining data protection compliance.
The Legal Framework
UK GDPR (the UK General Data Protection Regulation) applies whenever AI systems process personal data—which is most of the time. The key requirements:
Lawful basis: You need a valid legal reason to process personal data Purpose limitation: Data should only be used for specified purposes Data minimisation: Only process data that's necessary Accuracy: Keep personal data accurate and up to date Storage limitation: Don't keep data longer than needed Security: Protect data with appropriate measures Accountability: Be able to demonstrate complianceAdditionally, Article 22 provides specific rights around automated decision-making.
Establishing Lawful Basis
For AI processing, common lawful bases include:
Consent
When it works: User explicitly agrees to AI processing Requirements:- Freely given, specific, informed, and unambiguous

- Consent must be specific—generic "AI processing" consent is problematic
- Withdrawal must be practical—can you actually stop processing?

- AI features within contracted services
- Personalisation that's part of the service
- Must be genuinely necessary, not optional features
- Can't bundle AI processing to manufacture necessity
Legal Obligation

Transparency Requirements
Individuals have a right to know when AI is involved in decisions about them.
Privacy Notices
Your privacy notice should explain:
- That AI/automated processing occurs
- What decisions it informs or makes
- The logic involved (in understandable terms)
- The significance and consequences

When AI makes or significantly influences decisions:
- Inform individuals that AI is involved
- Explain how they can seek human review
- Provide meaningful information about the logic
Challenges with AI Transparency

Article 22: Automated Decision-Making
Article 22 gives individuals the right not to be subject to decisions based solely on automated processing that produce legal or similarly significant effects.
When It Applies
The right applies when: 1. A decision is made with no meaningful human involvement, AND 2. It produces legal effects (e.g., credit decisions) or similarly significant effects (e.g., job applications)
Exemptions
You can make such decisions if:
- Necessary for contract performance
- Authorised by law
- Based on explicit consent
Required Safeguards
When Article 22 applies, you must:
- Provide meaningful information about the logic
- Give the right to human intervention
- Allow individuals to express their views
- Enable individuals to contest decisions
Practical Implications
Design for human oversight: Even if humans don't review every decision, there should be a meaningful review option. Don't pretend: "Human-in-the-loop" must be genuine. A human rubber-stamping AI decisions doesn't count. Special categories: Automated decisions cannot be based on special category data (race, health, etc.) unless explicit consent or substantial public interest.Data Protection Impact Assessments (DPIAs)
A DPIA is mandatory when processing is "likely to result in high risk to individuals."
